Court recommends Wall motion denied

U.S. Magistrate Judge James C. England today issued his recommendation that the court deny a motion from Roger E. Wall, former associate circuit judge in Douglas County, to supress all evidence seized as a result of search warrants that were executed in December 2004. That recommendation will now be considered by U.S. District Judge Richard E. Dorr for a final ruling.

CassTel fraud sentencing

A sentencing hearing has been scheduled for Daniel D. Martino (New York), who pleaded guilty to a $9 million conspiracy to commit mail and wire fraud involving Cass County Telephone Company. Martino will be sentenced at 2:15 p.m. Wednesday, Nov. 23, inCourtroom 7B.

Conviction, death penalty upheld

The U.S. Court of Appeals today affirmed the kidnaping, rape and murder convictions and sentence of death for Wesley Ira Purkey.

In a published opinion, the court ruled: "A jury convicted Wesley Purkey of the kidnapping, rape, and murder of Jennifer Long, and sentenced him to death. See 18 U.S.C. ยงยง 1201(a), (g), 3559(d), 3591-3598. On appeal, Mr. Purkey raises myriad challenges to his conviction and sentence. After careful review, we conclude that his arguments lack merit and therefore affirm the judgment of the district court."
